Settlement awards were mailed on Friday, March 7, 2014 to all qualified individuals who completed a valid claim form.

This is a settlement in a class action lawsuit relating to calls allegedly made by Fifth Third Bank to cell phones through the use of an automatic telephone dialing system and/or artificial or prerecorded voice  between March 6, 2008 and June 11, 2013 without a person's prior consent. 

The distribution of settlement awards to qualified individuals who completed a valid claim form will begin the first week of March 2014.  The amount of the checks was calculated according to the calculation of settlement awards in the Settlement Agreement approved by the US District Court.  Only one claim per telephone number per class member was permitted, per the Settlement Agreement.

Submit a Claim Form

This is the only way to get a payment.

Your claim form must be filed online or mailed and postmarked by November 22, 2013.

Exclude Yourself

Get no payment.  This is the only option that allows you to ever be part of any other lawsuit against Fifth Third about the legal claims in this case.

Your exclusion request must be postmarked on or before October 10, 2013.

Object to the Settlement

Write to the Court about why you don’t like the settlement.

Your objection must be postmarked on or before October 10, 2013.

Go to a Hearing

Ask to speak in Court about the fairness of the settlement.

Your request to appear at the hearing must be postmarked on or before October 10, 2013.

Do Nothing

Get no payment.  Give up rights.
